The following Terms and Conditions are a part of the Regulations of the District and the delivery of water and sewer service is conditional upon their acceptance. All or any part of these Terms, Conditions, Rates, Fees, and Regulations may be amended at the Annual Meeting or Special Meeting of the District, as provided in the By-Laws.

1. Supply of Water:

The District will not guarantee an uninterrupted or unlimited full supply of water but will endeavor to give satisfaction to all users.

2. Application for Service:

An application for water and sewer service shall be made in writing to the Commissioners by the owner of the real estate for which water or sewer service is to be supplied. An application form may be obtained from the Warner Village Water District office at the wastewater treatment plant. (4)

An applicant for service other than typical domestic uses may, at the discretion of the Commissioners, be required to compensate the District to retain independent engineering services to evaluate the impact of the application on the water and sewer systems, to ensure proper installation of system extensions, or to otherwise protect the interests of the District.(6)

An applicant desiring to have water and/or sewer service connected shall give the district a minimum of 48 hours notice, excluding weekend days, and shall pay the applicable hookup fees prior to connection. (15)

3. Installation and Maintenance of Service Pipe:

A hookup fee of $2,000.00 (9) will be charged to all new residential customers tying into the District’s water system. A hookup fee of $8.00 per gallon of water per day estimated to be supplied, with a minimum fee of $2,000.00, will be charged to all new nonresidential customers. (10)

The District shall install the portion of the service line from the main to the point at the edge of the road where the shutoff is installed (herein after called the "service pipe"). In any case where ledge is encountered, the customer will also be charged for the additional cost of removing same. The customer shall install, own and maintain the portion of the service line from the shutoff to the customer’s premises. Such installations shall be in accordance with the District’s  Water and Sewer Ordinances.(17) The customer shall pay all of the costs of the entire installation from the main to the shutoff and from the shutoff to the customer’s premises, including all labor and materials.

4. Installation and Maintenance of Sewer Pipe:

All sewer pipes from the main line to the building shall be installed and maintained at the expense of the customer; materials required may be supplied by the District at cost. An entrance fee of $2,000 (9) will be charged to residential customers tying into the District sewer system. 

An entrance fee of $8.00 per gallon of water per day estimated to be supplied, with a minimum fee of $2,000, will be charged to all new nonresidential customers.(10)

5. Temporary Services:

When permission to open a street cannot be obtained or when for any physical reason it is impracticable to make excavation and provide independent service or to go beyond the bounds of the Precinct, water may be furnished temporarily from an adjacent service deemed advisable by the Commissioners and if the owner gives his permission; such service delivery shall be entirely at the expense of the customer requesting such service. Water service furnished to any housing or trailer not placed on a permanent foundation shall be considered temporary service and the whole cost of furnishing service from the nearest available main shall be entirely at the expense of the customer.

6. Meter Installation Kit (17):

Every new service installation must be provided with a backflow preventer (9), expansion tank, required shut off valve, yoke, meter housing, register assembly and remote reader (17)  located inside the building near the service entrance, easily accessible and protected from freezing.

7. Maintenance of Plumbing:

All customers shall maintain the plumbing fixtures within their own premises at their expense, in good repair, and protected from freezing. They shall make any repairs, which may be necessary to prevent leakage and damage. No cross connection between the District’s water supply system and any other supply will be permitted unless properly protected and approved by the Commissioners. No connection capable of causing a backflow between the District’s water supply system and any plumbing fixture, device or appliance, or between waste outlet or pipe having connection to waste drains will be permitted. If the owner of the connection fails or refuses to break or properly protect the connection for twenty-four hours after written notice by the District, service shall be discontinued by making a definite break in the service pipe until the connection has been properly changed. 

All cross connections shall be governed by the specifications of the Commissioners as established from time to time. (4)

8. Safeguarding Use of Hot Water Tanks:

All customers having direct pressure hot water tanks must place proper vacuum and relief valves in the pipe system to prevent any damage to such tanks should it become necessary to shut off the water on the street mains or to pump water from nearby hydrants with Fire Department apparatus. The District shall not be liable for damages to any hot water tank on the customers’ premises.

9. Winter Construction:

Ordinarily no new service for extension of main pipes will be installed during winter conditions when frost is in the ground. In case of emergency the customer requiring such construction at increased cost shall pay all such costs.

10. Joint Use of Service Pipe Trench:

Water service pipes will not be placed in the same trench with sewer pipes, gas pipes, electric conduits, or similar structures, unless special construction methods are used and approved by the District.(17)

11. Charges for Water and Sewer Services:

All charges for usage will be computed on the basis of water meter readings taken quarterly. The unit of measure on these meters read in one hundred (100) gallons. Charges are based on the meter reading to the nearest 1,000 gallons. An availability charge of $15.00 for water supply service and $15.00 for sewer service shall be assessed each quarter for each unit served by each main meter.(14) A unit is defined as being either a nonresidential use on the property, such as a restaurant, or a residential unit. A residential unit is further defined as a dwelling unit with complete plumbing facilities, meaning kitchen and bathroom. In addition, usage fees for water and sewer services provided, based on gallons of metered water shall be assessed each quarter as stated in the General Service - Metered Rate Schedule of these By-Laws.(8)

Any user, residential, commercial, or industrial, served by the Warner Village Water District for water and/or sewerage which is outside the boundaries of said District shall be assessed an annual fee for such services in addition to the applicable usage fees. Said fee shall be assessed on a semi-annual(10) basis and shall be determined by multiplying the assessed valuation of the premises served by the tax rate established for the Warner Village Water District. The assessed valuation shall be the same as established by the Town of Warner for town taxation purposes. Said fee shall be assessed against the owner of record on April 1st of the year and billed simultaneously with the said owner’s annual tax statement.(4)

These rates are subject to change by majority vote of the District Commissioners, pursuant to RSA 38:27, only after a duly noticed public hearing.(17)

The owner of record at the time the meter is read is responsible for all charges for water and sewer service from the time of the previous quarterly billing.

12. Billing:

Bills are sent quarterly and are due and payable to the Commissioners of the District upon presentation. These bills are computed on the basis of meter readings of water usage by each customer. In the event that the District’s representative is unable to read a meter because of obstruction or damage to the meter or the recording apparatus, the billing shall be based upon an estimate of use equal to the amount of water used during the previous billing period.

13. Disconnection for Non-Payment:

If a bill is not paid within 30days after the date of presentation, service will be disconnected after a 30-day written notice is sent to the owner of the property. Reconnection will not be made until all charges including penalties have been paid plus a reconnection charge of $25.00.

A penalty equal to one and one-half per cent of the outstanding unpaid balance each month will be assessed if the total billing is not paid within 30 days (7) of billing, said penalty to be added to the next quarterly billing. (5) There will be a service charge of  $25.00 (17) for checks returned for insufficient funds.

14. Responsibility for Water Charges:

The owner of the property supplied will be charged for all water and sewer service furnished to the premises during his ownership, and will be held liable for all charges. Bills will not be sent to tenants by the District. Any unpaid balance shall be the responsibility of the owner and the service subject to disconnection as provided in these Terms and Conditions.

15. Changes in Ownership:

When the ownership of property changes, the full name and address of the new owner shall be given to the District by the seller at  the time of the change of ownership (17) so that bills may be properly charged. This notice should be addressed to the Commissioners. The division of charges for water and sewer service for property transferred between the quarterly billing dates shall be the responsibility of the purchasing party. Any prorating of charges shall be settled between the buyer and seller of the property. The Commissioners may assist the two parties in dividing the cost of service for the current billing period provided they are contacted in sufficient time in advance of the transfer for the meter to be read and the charges computed for usage to date.

16. Customer’s Responsibility:

Charges for services under these Terms and Conditions or under any agreement between the District and the customer shall be continued to the end of the term specified thereafter or until such time as the District receives reasonable notice from the owner to terminate service.

17. Deposits:

Where a customer has not established credit relations satisfactory to the District, the District may require a deposit before furnishing or reconnecting service in an amount specified by the Commissioners, but in no case less than the annual availability (10) charge.

Upon termination of service the District shall have the right to apply any deposit in payment of any billing in arrears if such billing shall be unpaid for a period of 30 days beyond the due date. Retention of the deposit by the District shall not constitute a waiver of its rights otherwise to enforce collection of payment in accordance with the Terms and Conditions hereof. Deposits will be refunded after credit has been established or upon termination of service.

18. Customer’s Premises:

The customer’s installation shall comply with the rules and regulations of all authorities having jurisdiction. The District shall have right-of-way for its pipes and other equipment on the customer’s premises. The customer shall provide for safekeeping of the meter and equipment of the District and shall not permit interference therewith except by authorized employees of the District or licensed plumbers with specific permission from the Commissioners. In case of loss or damage to the property supplied by the District, the customer shall pay to the District the value of such property or the cost of repairs.

19. Right of Access:

Any authorized representative of the District shall have the right of access at any reasonable time to any part of any customer’s premises for the purpose of inspection, meter reading, repair or replacement of meters, or any other legitimate purpose and at any time in case of an emergency.

20. Meters:

All water service shall be metered. Meters will be paid for by the owner, but supplied and owned by the District and installed by a licensed plumber at the owner’s expense. (17)   The District will be responsible for repairs due to normal wear of the apparatus. The owner of the property shall be held responsible for repairs or replacement necessitated by freezing, hot water, or by neglect of the customer. Such costs shall be charged to the owner.

All meters shall be set, as nearly as possible, at the point of entrance of the service pipe to the building and in a proper and accessible location for all purposes. Meters once set may be changed in location at the request of the customer only at his expense and provided the change has been authorized by the Commissioners of the District.

In case of meter registration failure or removal for repairs, charges for water consumption shall be based on an average of the amount registered over similar preceding periods.

For all new installations under this section,  refer to Section 6. Meter Installation Kit. (17) The register assembly and remote reader are to read in gallons. (9)  The remote reader will be installed by the District. (17)

Meters shall be carefully tested before installation. All future testing shall be made according to the requirements of the District as specified by the Commissioners.

Tampering with meters is a violation within the meaning of the criminal code and penalties therefor shall be consistent with RSA Chapter 651. Tampering is defined as the breaking of the meter seal for the purpose of avoiding payment of water and/or sewerage charges. The terms shall also include any other intentional interference with the proper operation of a meter.(4)

20a. Second Water Meter:

Application for a second set of water meters (one meter plumbed inside the residence and one register on the outside wall) must be by a written request to the Commissioners. All plumbing for the inside water meter will be done by a licensed plumber and at the owner’s expense. District employees will install the outside register and the interior water meter. Costs for the second meter, installation and materials will be determined by the District. The owner is responsible for these costs and payment must be made prior to installation. (8)

Maintenance and/or replacement of the register and/or the meter will be at the owner’s expense. A charge of $20.00 will be assessed for removal of the second set of meters. The District will buy back the meter and register at a prorated amount of the cost of the meter to be determined by the Commissioners at the time of disconnection. Restoration of the water line after removal of the second water meter will be the responsibility of the owner.(8)

21. Liability for Interrupted or Unsatisfactory Service:

If by reason of shortage of supply or for the purpose of making repairs, extensions or connections or for any other reason beyond the control of the District it becomes necessary to shut off the water in the mains, the District shall not be responsible for any damage occasioned by such shutoff. Notice of shutoff and flushing of mains or hydrants will be given where practicable, but nothing in this rule shall be construed as requiring the giving of such notice.

The District will not be responsible for damage caused by dirty water which may be occasioned by cleaning or repair (7) of pipes, reservoirs or standpipes, or the opening or closing of any gates or hydrants.

Without limiting the generality of the foregoing, if for any reason beyond the reasonable control of the Commissioners or agents or employees of the Warner Village Water District, the said District is unable to or fails to supply quality water to its customers, neither the District nor its Commissioners, employees and agents shall be liable for damages resulting therefrom. (4)

22. Tampering:

No gates, valves, shutoffs or standpipes which are the property of the District are to be opened or closed or in any other way tampered with by any person other than those authorized by the District Commissioners.

23. Work on Private Property:

Any person who wishes to build or rebuild any walk or driveway or do any other work which may in any way affect any property of the District or the amount or type of cover over any existing water main or service pipe, must first apply to the District for permission to do so and agree to pay any additional cost to the District as a result of such work.

24. Private Fire Protection:

Customers desiring private fire protection must consult before installation with the District Commissioners as to the availability of mains, pressure, etc.

25. Hydrants:

Hydrants may only be used for the extinguishment of fires, flushing of water mains, or for such other purposes as may be approved by the District Commissioners. Approved water service from a hydrant for construction and other uses, is subject to the following fees: (12)

For unmetered consumption, for each 30 day period:

$ 300.00 for 5/8" diameter connection

$ 700.00 for > 5/8" to < 2 ½" diameter connection

$ 1,500.00 for 2 ½" diameter connection

$ 6,000.00 for 4" diameter connection

For metered consumption, using any sized connection:

$ 8.00 per 1,000 gallons used.

26. Unauthorized Use of Water:

No person shall take or use water contrary to the Terms and Conditions of the District or take or use water illegally or in such a way as to evade the scheduled rates or metered usage charges.

27. Extensions of Service Mains:

In the case of an extension of water service or sewer service outside the limits and bounds of the present District, the petitioner shall pay 100% of the cost before the work shall begin and a certified check shall be in the hands of the Treasurer of the District before the work will commence.

The petitioner for any extension must make application to the Commissioners in writing. Refer also to the By-laws of the Warner Village Water District, Article IV, Section 2. (17)

28. Limit of Water Usage:

The Commissioners of the Warner Village Water District are empowered to limit water usage by type of usage and/or duration of said use during periods of limited water supply.

29. Change of Use:

No existing water or sewer service shall be allowed to change its purpose (such as, but not limited to, changing from single to multi-use, from private to commercial use) without requesting same in writing by the owner of record to the Commissioners and being granted permission to effect the change in writing by the Commissioners. The Commissioners reserve the right to assess an additional tie-in fee in such cases where the increase in water and/or sewer usage is greater than 150% of the average use over the past three years of record.(10)

If there is a change of use where water and sewer are already established, an additional tie-in fee may be assessed as determined by the District Commissioners. (17)

30. Service Call Fees:

Fees for requested water shut-off and turn-on shall be  $25.00 (17) per service call. If the requested service is required other than during regular working hours, the fee will be $50.00 (17) per service call.

GENERAL SERVICE - METERED RATE SCHEDULE

Availability:

This schedule is applicable to all water service and sewer service furnished by the District.

Character of Service:

Water is obtained from the Royce Well site near the Warner River . The distribution system is pressurized by a pump off Chemical Road and by gravity flow from storage tanks in Carroll State Forest (7) and on Latting Lane . (17)

Computation of Charges:

All rates are stated for a quarterly period. (10) The sewer charge is based on the amount of water used as shown by the main meter readings, less the amount of water used as shown on a second meter, if one is in service.

Rates:

For Water Supply:

Availability fee: $15.00 per quarter (14)

A usage fee of $5.60 per 1000 gallons. (17)

For Sewer Service:

Availability fee: $15.00 per quarter (14)

A usage fee of $8.10 per 1000 gallons, based on the water meter reading. (14)
